Last Friday, January 21, was the last day for committees to hear any bills introduced last year in that house. Here are some bills that C.A.R. is supporting or opposing that did make the deadline and which we will continue to be engaged in.
AB 854 (Lee) Ellis Act- OPPOSE
The Ellis Act was Sponsored by C.A.R and enacted by the Legislature in 1985. The Ellis Act prohibits local government agencies from forcing property owners to continue operating their private properties as rental businesses in rent control jurisdictions. AB 854 forces property owners to stay in the rental business, regardless of the viability of that business, for at least 5 years before being able to use the Ellis Act to go out of business.
This bill passed out of the Assembly Appropriations Committee on January 20th. The bill could come to the Assembly Floor by Thursday of this week. C.A.R., in conjunction with its allies, is mobilizing against this bill utilizing key contacts and red alerts in selected districts.
AB 1093 (Jones-Sawyer) California Notary Protection Act- OPPOSE UNLESS AMENDED
While C.A.R. supports online notarization, C.A.R. and the California Land and Title Association oppose AB 1093 which could retroactively invalidate real estate transactions. The Assembly Judiciary Committee amendments adopted on January 3rd would invalidate, or at least put into question, the long-standing interstate recognition doctrine if a remotely notarized document is executed in another state – potentially invalidating any recording made outside of California. The amendments will create gaps in the title record and opens realtors and their clients to liability based on who notarized the documents completing their transaction. C.A.R. will oppose AB 1093 until our concerns are resolved.

SB 379 (Wiener) Residential Solar Energy Systems: Permitting- SUPPORT
This bill would require local governments to implement an online, automated permitting platform that verifies code compliance and issues permits in real time for average sized single family solar energy systems.
This bill passed out of the Senate Appropriations on January 20th and will now go to the Senate Floor for a vote.
